It is common practice in construction contracts that variations are issued to the contractor after the contractual completion date. There are two opposing schools of thoughts on the extent to which the contractor is entitled to extension of time, namely the "net" and "gross" methods. Intermingled with those schools of thought are different opinions regarding the application of liquidated damages. Join us in this webinar, which is set as a hearing in an arbitration case in which Eng. Mahmoud El Saadany acts as sole arbitrator, Dr. Waleed El Nemr as the claimant contractor and Eng. Amr Askar as the respondent employer. The hearing is for a construction case (using FIDIC 2017 Red Book), where a variation is issued after the contract completion date and liquidated damages are applied on the contractor. |
