The Cairo Regional Centre for International Commercial Arbitration (CRCICA) participated in the conference titled “The Settlement of International Energy Disputes in the Middle East,” held on 24 April 2024 in Abu Dhabi. This significant event was jointly organized by the International Centre for Settlement of Investment Disputes (ICSID) and the Abu Dhabi Global Market (ADGM), bringing together distinguished legal professionals and arbitration experts to discuss pressing issues in energy dispute resolution.
Dr. Ismail Selim, Director of CRCICA, was a featured speaker at the conference. During his insightful presentation, Dr. Selim explored the doctrine of exceptional circumstances as stipulated under Article 147(2) of the Egyptian Civil Code. He elaborated on the conditions necessary for invoking this doctrine, the authority vested in judges and arbitrators when such conditions are met, and the public policy implications of this legal provision.
To provide a comprehensive understanding, Dr. Selim supplemented his analysis with a practical example from Egyptian court rulings, demonstrating the real-world application of this principle in energy-related disputes.
