Arbitration Costs & Calculator

CRCICA Costs Calculator

Parties can easily determine how much bringing a claim to arbitration is going to cost them by using the CRCICA Costs Calculator, ensuring the transparency of the fee structure and foreseeability of the costs.

This Calculator enables prospective parties to CRCICA arbitrations to foresee the applicable costs of the arbitration. This is in accordance with Table (1) referring to the “Administrative Fees”, Table (2) referring to the “Sole Arbitrator Fees” or Table (3) referring to the “Fees of the Arbitral Tribunal (3 or more arbitrators)” in Annex 1 to the CRCICA Arbitration Rules in force as from 15 January 2024, which apply to arbitrations filed after this date.

Once you input the sum in dispute in US Dollars and indicate the number of arbitrators to be appointed, the calculator will provide an indicative estimate of the Administrative Fees and Fees of the Arbitral Tribunal.

Please note that the CRCICA Costs Calculator does not take into account the non-refundable registration fee amounting to USD 500 or USD 1,000, depending on the sum in dispute, payable upon filing a notice of arbitration or a counterclaim.

It is worth mentioning that where the sum in dispute is 500,000 US Dollars, the Fees of the Arbitral Tribunal in Tables (2) or (3) in Annex (1) to the CRCICA Arbitration Rules, the estimate of the total costs of the arbitration is made based on the minimum arbitrators’ fees. Also, the estimate of the Administrative Fees and Fees of the Arbitral Tribunal is also exclusive of any expenses (Article 41(2)(d-f) of the CRCICA Arbitration Rules).

If the parties select expedited arbitration, the CRCICA Expedited Arbitration Rules in Annex 3 to the CRCICA Arbitration Rules shall apply in accordance with the Arbitrator’s Fees (Expedited Arbitration) located at the end of Annex. It is worth noting that the “Arbitrator’s Fees (Expedited Arbitration)” is calculated based 20% less than the “Sole Arbitrator’s Fees” found in Annex 1 to the CRCICA Arbitration Rules, while the non-refundable registration fees and the Administrative Fees in Annex 1 to the CRCICA Arbitration Rules are maintained.

CRCICA Arbitration Costs

Costs of Arbitration

CRCICA’s services, including its arbitration costs (i.e. the Centre’s Administrative Fees and the Fees of the Arbitral Tribunal), are cost effective, with a high quality to price ratio.

The Tables of the Administrative Fees and the Fees of the Arbitral Tribunal in Annex 1 to the New Rules have been modified to respond to a decade of economic developments, taking into consideration the importance of striking a balance between cost effectiveness and maintaining high quality services to best serve the interests of users.

In the 2024 Arbitration Rules, the table of Administrative Fees has been amended by a slight increase in it, taking into account that CRCICA remains in the first place as the Centre with lowest administrative fees for sums in dispute that do not exceed one million US dollars.

The Fees of the Arbitral Tribunal have been amended by a slight increase for all sums in dispute less than one million US dollars, with the already existing fixed amounts replaced with a logical ascending sections so that the fees of the arbitral tribunal would be proportionate with the sum in dispute.

A new Table (2) for the Fees of the Sole Arbitrator has been introduced for the first time, whereby an amendment of the sole arbitrator’s fees becomes 35% of the fees of Table (3) (i.e. fees of the 3 member tribunal or more).

It is worth mentioning that a minimum and maximum scales have been applied in the Rules in relation to sums in disputes starting from 500,000 (five hundred thousand) US dollars.

Expedited Arbitration Rules

If the parties decide to apply the CRCICA Expedited Arbitration Rules in Annex 3 to the CRCICA Arbitration Rules, then it is worth noting that the “Arbitrator’s Fees (Expedited Arbitration)” is 20% less than the “Sole Arbitrator’s Fees” found in Annex 1 to the CRCICA Arbitration Rules, while the non-refundable registration fees and the Administrative Fees in Annex 1 to the CRCICA Arbitration Rules are maintained.

Emergency Arbitrator Rules

In accordance with Article 11 paragraphs 1 and 2 of Annex II to the Rules, the costs of the emergency arbitrator proceedings shall be finally determined by the Centre and shall include:

  1. The fee of the emergency arbitrator which shall not be less than the minimum amount of 10000 (ten thousand) US Dollars and shall not exceed the maximum amount of 30000 (thirty thousand) US Dollars; and
  2. The application fee of 5000 (five thousand) US Dollars.

CRCICA’s Rank in GAR’s Arbitration Costs Compared report

On 25 January 2018, later updated on 23 April 2021, the Global Arbitration Review (GAR) published its ‘Arbitration Costs Compared’ report, comparing the arbitration costs from different arbitral institutions around the world, including the registration fees, the administrative fees, and the arbitrators’ fees.

According to the report, in cases where the sum in dispute does not exceed USD 100,000 (one hundred thousand), CRCICA is still the least expensive institution when appointing a sole arbitrator and one of the three least expensive institutions when appointing three arbitrators.

According to the report, in cases where the sum in dispute does not exceed USD 500,000 (five hundred thousand), CRCICA ranks amongst the top ten least expensive institutions when appointing a sole arbitrator and one of the five least expensive institutions when appointing three arbitrators.

According to the report, in cases where the sum in dispute does not exceed USD 1 million, CRCICA ranks amongst the top ten least expensive institutions when appointing a sole arbitrator and the same position when appointing three arbitrators.

For cases with a sum in dispute of USD 5 million and USD 10 million, CRCICA’s arbitration fees rank 13th and 12th, respectively, out of the 17 arbitral institutions considered.

Other Important Remarks

It is worth noting that in accordance with article 1, paragraph 1 and article 42, paragraph 1 of the Rules, the provisions stipulated in Section V titled “Costs of arbitration” shall apply irrespective of the version of the Rules agreed upon by the parties.

It is worth mentioning that the use of hearings rooms at the Centre’s premises is included in the administrative fees.

Regarding the value of disputes administered by the Centre, while up to half the cases in a given year will have a sum in dispute not exceeding USD 1 million, the Centre also administers multi-billion-dollar cases. For example, in 2015 the total sum in dispute in a gas supply case reached USD 6,435,713,084 representing as such a new record for the aggregate sums in dispute.

Further, CRCICA has witnessed an increase in the number of cases with higher sums in disputes. For example, CRCICA recorded a 153% relative increase in the number of disputes with a sum in dispute exceeding USD 50 million between 2017 and 2021.
