CRCICA Workshop on the Judicial Practice in the Application of Arbitration Law

On Sunday, 22 June 2025, the Cairo Regional Centre for International Commercial Arbitration (CRCICA) organized a prestigious workshop titled “Judicial Practice in the Application of Arbitration Law”. The workshop was organized under the auspices of the Egyptian Ministry of Justice and brought together leading figures from the judiciary, legal academia, and arbitration community for an in-depth dialogue on key issues shaping arbitration practice in Egypt.

This workshop opened in depth dialogue among judges and legal experts on the practical challenges related to the application of Egyptian arbitration law provisions before national courts. Opening remarks were delivered by Judge Hossam Sadek, Assistant Minister of Justice for International and Cultural Cooperation, Judge Aly El Hawary, President at the Cairo Court of Appeal – Head of the Technical Bureau and Dr. Ismail Selim, Director of CRCICA

The day’s discussions began with a session addressing the judiciary’s role in enforcing arbitration agreements. The session, moderated by Judge Dr. Hassan El-Badrawy, former Vice President of the Court of Cassation, explored critical topics such as the concept of waiver of arbitration agreements in Egyptian and comparative law, presented by Professor Dr. Ahmed Weshahi, Senior Partner at Alieldean Wshahi & Partners,  and the applicable law governing arbitration agreements, presented by Judge Dr. Khaled El-Qadi, President at the Cairo Court of Appeal. The session concluded with an interactive exchange of views and experiences between speakers and participants.

The second session focused on interim and conservatory measures issued by arbitral tribunals and emergency arbitrators. The session featured insightful presentations from Dr. Ismail Selim, who examined the emergency arbitrator system under CRCICA’s rules and other institutional frameworks, and Professor Dr. Mohamed Sameh Amr, Founding and Managing Partner at Amr & Partners Law Firm, who discussed precedents of Egyptian courts regarding the enforcement of such measures.

The final session addressed the complex issue of interpreting Article 3 of the Egyptian Arbitration Law. The discussion was moderated by H.E. Judge Ahmed Saeed Khalil, former Vice President of the Court of Cassation, with key contributions from Judge Dr. Hassan El-Badrawy, Former Vice President of the Court of Cassation, who analyzed the legislative context of Article 3, and Dr. Hani Sarie-Eldin, Member of the Egyptian Senate and Managing Partner of Sarie-Eldin & Partners, who reflected on the legislative impact of conflicting court rulings on the interpretation of the article and the draft amendments to Article 3 and a few other articles of the Egyptian Arbitration Law.

This highly interactive event reflected CRCICA’s ongoing commitment to fostering dialogue between the judiciary and the arbitration community through CRCICA, contributing to the development of arbitration practice in Egypt and the wider region.
