Caseload Report 2nd Quarter 2023
The total number of cases filed before CRCICA until 30 June 2023 reached 1649 cases. In the second quarter of 2023, 16 new cases were filed compared to 17 new cases filed in the second quarter of 2022.
Of the 16 cases filed this quarter, 4 related to ad hoc proceedings, representing 25% of cases, while the remaining 12 cases related to CRCICA proceedings.
The Centre’s caseload in the second quarter of 2023 involved disputes relating to various sectors, including Construction, Corporate Restructuring, Pharmaceutical, Tourism & Hospitality, Real Estate Development and Retail.
Seven cases related to the construction sector. Four cases involved contracts for works. The first case related to contract for electrical works in a project located east of Cairo, Egypt. The second case related to a contract for structural works in a commercial project located in New Cairo, Egypt. The third case related to a contract for installation and welding works at an oil depot located in Suez, Egypt. The fourth case related to a contract for electromechanical works for an energy project located in Alexandria, Egypt. Two cases involved agreements for supply and installation. The first case related to a contract for the supply and installation of a pharmaceutical water line for project located in Cairo, Egypt between an Italian sub-contractor and an Egyptian contractor. The second case related to a contract for the supply and installation of a central air conditioning system for an industrial project located in Gharbiya Governorate, Egypt. One case involved a project management agreement to manage and oversee construction works for a residential project located in 6th October City, Egypt.
One case involved a dispute arising out of a settlement agreement between a Korean company and an Egyptian public entity, an Egyptian company and a Kuwaiti company. One case involved a consultancy agreement related to a corporate structuring transaction between an Egyptian individual and two Egyptian companies.
One case related to the pharmaceutical industry and involved an exclusive manufacturing agreement between an Egyptian company and a Saudi company.
One case related to the tourism & hospitality sector and involved an agreement for the lease of a hotel located in Sharm El Sheikh between two Egyptian companies.
One case related to the real estate development sector and involved a real estate and engineering consulting agreement for the development of a residential project located in New Mansoura, Egypt.
One case related to the retail sector and involved the lease of a commercial unit in a project located in 6th October, Egypt between two Egyptian companies.
One case involved the lease of a space located in Kattameya, Egypt between an Egyptian individual and an Egyptian company. One case involved an employment contract between an Egyptian individual and an Egyptian public university. One case involved the purchase of an industrial unit located in 6th October, Egypt, between two Egyptian companies.
Arbitration proceedings in the second quarter involved parties from Egypt, Italy, Korea, Kuwait and Saudi Arabia.
The second quarter of 2023 witnessed the appointment of 30 arbitrators from Egypt, France, Lebanon and Tunisia.
Of the 30 arbitrators appointed this quarter, there was one female arbitrator, representing 3% of appointments, and 4 arbitrators were under the age of 40, representing 13% of appointments.
The Centre acted as appointing authority for some cases, appointing 4 of the 30 arbitrators appointed this quarter, representing 13% of appointments, including 2 arbitrators under the age of 40.
Amongst the 16 cases filed in this quarter, 13 cases, representing 81% of cases, were conducted in Arabic, while 3 cases, representing 19%, were conducted in English.
HEARINGS:
During the second quarter of 2023, CRCICA hosted 23 hearings. Since the outbreak of COVID-19, the Centre’s promotion of remote hearing solutions has led to a diversification of the type of hearing held at CRCICA. This quarter, the Centre hosted 20 hearings with physical attendance, representing 87% of hearings, 2 fully-remote hearings, representing 9% of hearings, and one hearing with hybrid attendance, representing 4% of hearings.
Of the 23 hearings held this quarter, 5 related to ad hoc arbitral proceedings, representing 22% of hearings, one hearing related to non-CRCICA proceedings, and the remaining 17 hearings related CRCICA arbitral proceedings, representing 74% of hearings.
