On 20 November 2019, Dr. Selim participated at a panel discussion at the Shearman & Sterling and DELOS Dispute Resolution Seminar, addressed “Innovation in arbitration: What does it take to promote useful change?” moderated by Mr. Alex Bevan, Partner, Shearman & Sterling LLP.
This successful event was conducted in a discussion format (i.e. without presentations) and encouraged audience involvement from the outset.
Dr. Selim focused on the scope of neutrality and diversity in the appointment of arbitrators under CRCICA rules allowing each party to nominate freely its arbitrator even if not listed in CRCICA’s Panel of Arbitrators. Dr. Selim also spoke about the innovative provision of Article 14(2) of the CRCICA Rules whereby a party in exceptional circumstances, such as repeat mala fide or tactical resignations of its co-arbitrator and/or substitute arbitrator(s), may be deprived from its right to appoint a substitute arbitrator.
The other panelists were Ms. Asli Yilmaz (Counsel at the ICC), Hafez Virjee (President of Delos Dispute Resolution) and Ms. Lara Hammoud (Senior Legal Counsel at Abu Dhabi National Oil Company).
