The 38th Session of the UNCITRAL Working Group III: Investor-State Dispute Settlement Reform, Vienna, Austria

On 20-24 January 2020, Dr. Dalia Hussein, Deputy Director represented CRCICA at the Resumed 38th Session of the UNCITRAL Working Group III: Investor-State Dispute Settlement Reform. The session was attended by 56 member states, 40 observer states, and more than 50 observer organizations. The working group discussed the establishment of an appeal mechanism for awards rendered in investment disputes to increase consistency and guarantee the correctness of awards and focused on the grounds and extent of the appeal, its effect, the types of decisions subject to appeal, the establishment of a permanent appellate body, and its powers. Discussions also covered the enforcement of the decisions of the appeal mechanism in participating and non-participating states, the financing of such mechanism if established, and the various means of selection of arbitrators & adjudicators in ISDS tribunals.
