CRCICA’s Article for BCDR International Arbitration Review

Dr. Ismail Selim, Director of CRCICA, and Ms. Malak Lotfi, Case Manager and Legal Researcher, CRCICA Dispute Management Department, contributed to the thirteenth issue of the BCDR International Arbitration Review (Volume 7, no. 2), December 2020,  published by Kluwer Law International B.V., with an article titled “Challenges against Arbitrators under CRCICA Rules: The Effect of Disclosure”.

The article presented a brief overview of key aspects of disclosure under the CRCICA Rules as well as the procedure for challenge of arbitrators under the CRCICA Rules. The article provided examples of decisions of ad hoc tripartite committees in challenges based on disclosure and lack of disclosure using case studies.

The authors concluded that “the independence of arbitrators is not part of transnational procedural public policy. Such relative independence must be balanced by a strict disclosure obligation, in order to serve as an indicator of compliance with the more subjective concept of impartiality, which is an indispensable component of due process”.
