CRCICA’s recent Caseload: An unprecedented filing of Multiparty Arbitrations

The total number of arbitration cases filed before CRCICA until 30 September 2013 reached 919 cases. In the third quarter of 2013, 18 new arbitration cases were filed, out of which five multiparty arbitrations, representing 27%. An arbitral tribunal composed of five arbitrators will be appointed in one of those multiparty cases, while the other four cases will be conducted before a tripartite arbitral tribunal.

CRCICA’s caseload in the third quarter of 2013 involved disputes relating mainly to construction, lease agreements, real estate, supply contracts, investment agreements, services, petroleum services, sale and purchase of shares, hotel management, insurance, settlement agreements and international sale of goods.

It is worth noting that, in the third quarter of 2013, three cases arising out of construction contracts were filed before the Centre, one of which related to the construction and installation of a transformers factory in Badr City, Egypt. The second case related the construction of a wastewater treatment plant in Katameya, Cairo, Egypt, while the third case related to the construction of a faculty of engineering in Ismailia, Egypt.

The third quarter of 2013 also witnessed the filing of three cases arising out of lease agreements, two of which related to the lease of two areas in an attraction park in Zagazig, Egypt for commercial use as a movies theatre and a conference hall. The third case related to the lease of a diving centre in a hotel located in Hurghada, Egypt.

Two other cases arising out of real estate contracts were filed during the third quarter of 2013, one of which related to allocating a unit in a touristic, leisure and shopping centre in Heliopolis, Cairo, Egypt for use as a Cineplex. The second case related to the ownership of a residential building in Cairo, Egypt.

Two other cases related to the supply of desalinated water to a touristic complex in Sharm El-Sheikh, Egypt.

Other two disputes arising out of services contracts were filed before the Centre relating to the provision of consultancy services as well as petroleum services.

An investment case was also filed before the Centre arising out of a joint venture agreement between four entities for the establishment of a special vehicle dedicated to the development of an economic zone north west the Gulf of Suez, Egypt.

Another case was filed arising out of the sale and purchase of shares of a company specializing in the field of media and entertainment.

Also, a case arising out of an international sale of refractories products was filed under the auspices of the Centre during the third quarter of 2013.

A dispute arising out of an insurance policy concluded between an insurance company and a company manufacturing readymade garments in the industrial zone of 10th of Ramadan City, Egypt was also filed under the auspices of the Centre.

One case arising out of a contract for the management of a hotel in Hurghada, Egypt was also filed.

Finally, a settlement agreement concluded between an Egyptian bank and an Egyptian businessman gave rise to another dispute under the auspices of the Centre.

In the third quarter of 2013, arbitration proceedings involved parties from different countries including Egypt and Korea. The third quarter of 2013 also witnessed the appointment of arbitrators coming from Egypt, UAE, Lebanon, France and the UK.

The total sums in disputes filed under the auspices of the Centre during the third quarter of 2013 and until 30 September 2013 amounted to USD 97,980,325. The largest amount in dispute being USD 64,744,835.
