CRCICA Caseload: Fourth Quarter of 2018

The total number of cases filed before the CRCICA until 31 December 2018 reached 1303 cases. In the fourth quarter of 2018, 29 new cases were filed, compared to 22 new cases filed in the fourth quarter of 2017.

The Centre’s caseload in the second quarter of 2018 involved disputes related to the Construction industry, Oil & Gas, Real Estate Development, Tourism, Purchase Agreements, Lease Agreements, Media & Entertainment, Share Purchase Agreement, Hotel Management, Supply Agreement.

Eight cases related to purchase agreements. The first case related to the purchase of a housing unit in a compound in the Fifth Settlement, Cairo. Four other cases related to the purchase of units (apartments, chalets, villas) at resorts located in the Red Sea Governorate. The fifth case related to the purchase of a housing unit in a compound in Fifth Settlement, Cairo. Another case related to the purchase of land for the construction of a factory. The final case related to the purchase of a commercial unit in a project in the Fifth Settlement, Cairo.

Six cases related to the construction industry. There were three cases that arose from contracts for works. The first related to a contract for the installation of security cameras. The second involved works for different stations of a sugar factory. The third related to a contract for upgrading, finishing and expanding existing buildings. One case arose from a contract for civil works (infrastructure), which involved setting up a sewage system for two villages in Egypt. There was also a case that related to a contract for supply and works, involving a cement factory. The final construction case related to a contract for the construction of an automobile station.

Five cases related to disputes arising from Lease Agreements. There were three cases that related to leased commercial spaces in a mall in the Fifth Settlement, Cairo. One case related to the leasing restaurant space in a mall in the Fifth Settlement, Cairo, while the last case related to the leasing of a commercial space in the First Settlement, Cairo.

One case related to the Oil & Gas industry, involving an agency agreement between an Egyptian drilling company and a Lebanese agent.

One case involved an agreement for the supply of gym machines and equipment.

One case related to the Tourism industry. It involved the upgrade and expansion of a resort in Sharm El-Sheikh.

In a similar vein, there was a case involving an agreement for Hotel Management of a resort in Sharm El-Sheikh.

One case related to a Share Purchase Agreement between two Egyptian Companies.

One case related to the Media and Entertainment industry. It involved licensing broadcast rights for a television series.

The fourth quarter witnessed the appointment of arbitrators from Lebanon, Jordan, Tunisia, USA and Egypt. It also witnessed the appointment of 2 female arbitrators, as presiding arbitrators, as part of CRCICA’s endeavor vis-a-vis the Pledge for Equal Representation in Arbitration.

Arbitration proceedings in the fourth quarter involved parties from Russia, China, Lebanon, the Netherlands and Egypt.

Among the 29 cases filed this quarter, 4 were conducted in English (14% of the cases), while 25 were conducted in Arabic (86% of the cases).

HEARINGS FOURTH QUARTER 2018

Throughout this quarter, 19 hearings took place at CRCICA’s hearing facilities. Of these hearings, one related to an ad hoc case, while three related to two different ICC cases. The remaining 15 hearings related to cases under the CRCICA Rules.
